The Gladstone resident who struck and killed 73-year-old Kenneth Rogus last September was sentenced in court Tuesday.
Paul McCarty received the maximum time of 12 months in jail for a moving violation causing death.
For the felonious charge of operating a motor vehicle on a suspended license causing serious injury, McCarty received a 12 month delay of sentencing. This charge will be dismissed if he successfully completes probation.
The sentencing was based on the agreement made between the defendant and the Rogus family.
"I'm going to follow the contract between these two parties," said Judge Stephen Davis. "You have a lot to thank your attorney for, and the state, and the family."
After court, McCarty was immediately taken to the Delta County Jail.
