      Man accused of killing a 73-year-old pedestrian pleads no contest

      According to court documents, Gladstone resident Paul McCarty, 32, struck and killed Kenneth Rogus, 73, while driving his truck in September 2012.

      In Delta County Circuit Court, McCarty pled no contest, a five year felony, of operating a motor vehicle on a suspended license causing serious injury. In exchange, the court agreed to delay the sentencing with dismissal if he completes probation.

      McCarty also pled no contest to the misdemeanor charge of a moving violation causing death with a maximum sentence of one year.

      As part of the bargain, the court dismissed one count of operating a motor vehicle on a suspended license causing death, a 15 year felony.

      McCarty is scheduled to appear in court for sentencing April 8.
