Man sentenced for alleged baseball bat attack

28-year old Nicholas Yakovich was sentenced Wednesday.

He got 24 months to four years in prison. Yakovich allegedly attacked the victim with a baseball bat, breaking the victim's arm in January.

Witnesses say Yakovich said multiple times he intended to kill the victim.

The original charge was assault with intent to do great bodily harm, but was reduced with the plea bargain, that he wouldn't be sentenced as a repeat offender.

"I am sorry. I didn't mean to hurt him like this," says Yakovich. "I didn't mean to hurt anybody or do any of it. It's just all because of me being drunk. I don't think I deserve to go to prison."

"Whether this happened because you're drunk or not, I guess you know that's not an excuse," responded Judge Janis Burgess of Ontonagon Count Circuit Court. "You don't get away with something because you were so drunk you didn't know what you were doing."

Yakovich will receive 53 days credit on his sentence for time already served.
