One of the men involved in the armed robbery of a Palmer gas station is heading to trial.
Twenty-one-year-old Dakota Fuller took a guilty plea to unarmed robbery and was in Marquette Circuit Court for sentencing.
There was sentencing agreement with the scoring of the guidelines with the defendant's guilty plea, however, when the judge did not abide by that agreement, Fuller withdrew the deal.
The judge would have imposed a minimum 9 to 15 year sentence, two years higher than the probation recommendation of 7 to 15 years.
By withdrawing the plea, Fuller faces charges which include armed robbery and felony possession of a firearm.
Fuller can face up to life if convicted.
The prosecution nor the defense commented on the decision.
